The director actually wanted Cillian Murphy(the guy who played Scarecrow) to be "batman" but then they casted Christian Bale as batman, and the director casted Cillian Murphy as Scarecrow cause he thought he was that great. Interesting little tidbit i found out.

I don't think they're going to go that route. They're not hiring Katie Holmes back because they figured her and Tom's antics took away from movie publicity. They've already got a solid cast and fanbase, why would they risk more celebrity destractions with him?
Also, as for Cillian Murphy... I'll agree with Fidds; if he was 5 years younger and I was a different gender... there'd be no stopping me.
